Update
on Police Assaults
In
2005, the then General Secretary wrote to the Minister for Justice
expressing concern in relation to assaults on the police. Specifically,
he highlighted plea bargaining, downgrading of charges and ineffective
sentencing. He also expressed the SPF's wish to see Lord Advocate's
guidelines which would stop plea bargaining in such cases.
The
Minister for Justice has replied drawing attention to the Crown Office
Prosecution Code which gives a general explanation of factors which
influence prosecution decisions. She also mentioned guidance to Procurators
Fiscal which indicates that assaults on police will normally be prosecuted
in the Sheriff Court but consideration should be given to solemn proceedings
in serious cases. She stated that the Lord Advocate has no plans to
issue further guidance on plea adjustments.
I
have very recently met with senior representatives of the Crown Office
and they have agreed to carry out a snap-shot examination of how cases
of assaulting the police are being dealt with. I will keep you advised
of developments.
